registration fee for such higher classification, and if he
secures such higher classification license during the first
six months he shall be required to pay the higher fee for
the entire year, but if secured during the last six months
of the license year he shall be required to pay the higher
fee for one-half year, with a credit for the fee already paid
in each instance.

(g) When making application for license of motor ve-
hicle, tractor or trailer where registration fee is based on
maximum gross weight the applicant shall present a cer-
tificate giving the empty weight, including body, cabs,
spare tire, etc., and shall declare the load he decides to
carry.

(h) Maximum Gross Weight as used in this section,
shall mean the weight of the vehicle and load when the
vehicle is loaded.

Sec. SECTION 5. And be it further enacted, That Sec-
tions 269 and 271 of Article 81 of the Annotated Code of
Maryland (1951 Edition), title "Revenue and Taxes", sub-
title "Mileage Tax for Use and Maintenance of Roads", be
and they are hereby repealed and re-enacted, with amend-
ments, to read as follows:

269. It shall be the duty of each owner of a motor ve-
hicle to be used in the interstate transportation of pas-
sengers for hire operating over State, State-aid, improved
county roads, and streets and roads of incorporated towns
and cities in the State of Maryland: (1) to secure a permit
from the Public Service Commission of Maryland to op-
erate over said roads and streets; (2) to present same to
the Commissioner of Motor Vehicles annually, at the time
and according to the method and provisions prescribed
by law for the making of applications for registration tags
in the case of all other motor vehicles; (3) to make an
application in writing for registration with the Commis-
sioner of Motor Vehicles, and to state in said application
besides the other matters by law provided: (a) the seating
capacity for passengers of said motor vehicle; (b) the
route on which said motor vehicle is to be used; (c) whether
reserve or substitute motor vehicles are maintained by the
applicant to be used only in emergencies, and if so, the
number of such reserve and substitute motor vehicles and
a complete description of each, such motor vehicles when
in use to be designated by a special marker to be furnished
by the Commissioner of Motor Vehicles; (d) the length
