CHAPTER 149
(House Bill 132)

AN ACT to add six new sections to the Prince George's County
Code (1943 Edition), being Article 17 of the Code of Public
Local Laws of Maryland (1930 Edition), title "Prince
George's County", sub-title "Berwyn Heights", said new sec-
tions to be known as Sections 33A - 33F, inclusive, and to
follow immediately after Section 33 of said Code and Article,
authorizing the Commissioners of Berwyn Heights to con-
struct, maintain and repair streets, alleys, curbs, sidewalks
and gutters, to borrow money for same and issue bonds
therefor and to provide for special assessments and provid-
ing for a referendum thereon.

SECTION 1. Be it enacted by the General Assembly of Mary-
land,
That six new sections be and they are hereby added to
the Prince George's County Code (1943 Edition), being Article
17 of the Code of Public Local Laws of Maryland (1930 Edi-
tion), title "Prince George's County", sub-title "Berwyn
Heights", said new sections to be known as Sections 33A - 33F,
inclusive, to follow immediately after Section 33 of said Code
and Article, and to read as follows:

33A. The Commissioners of Berwyn Heights, Maryland, a
municipal corporation, are hereby authorized to construct,
maintain and repair streets, alleys, curbs, sidewalks and gut-
ters in said town of Berwyn Heights, when, where and in the
manner to be determined by the Commissioners, provided that
when such construction is to be paid for by special assessment
then such construction shall not be authorized without the
signature consent or request of fifty-one per cent (51%) of the
front foot abutting property owners, representing at least
fifty-one per cent (51%) of the front footage, affected on the
street or section thereof on which construction is proposed.

33B. To effectuate the construction of streets, alleys, curbs,
sidewalks and gutters, the Commissioners of Berwyn Heights,
Maryland, are hereby authorized and empowered to borrow
from time to time on the credit of the town, a sum or sums of
money which shall not, however, exceed in amount the total
sum of eight per cent of the assessed valuation of all real prop-
erty in the town appearing on the assessment books of Prince
