use is issued by the superintendent, and (2) may be con-
fiscated by the superintendent if not corrected as required
by this section or if used or disposed of contrary to the
requirements of this section.

11. Same: Police Powers: Right of Entry and Stop-
page. —With respect to the enforcement of this Act and
any other Acts dealing with weights and measures which
he is, or may be, empowered to enforce, the superintendent
is hereby vested with special police powers, and is author-
ized to arrest, without formal warranty any violator of the
said Acts, and to seize for use as evidence, without formal
warrant, incorrect or unsealed weights and measures or
amounts or packages of commodity, found to be used,
retained, offered or exposed for sale, or sold in violation
of law. In the performance of his official duties, the super-
intendent is authorized to enter into or upon, without for-
mal warrant, any commercial structure or premises, and
to stop any person whatsoever and to require him to pro-
ceed, with or without any vehicle of which he may be in
charge, to some place which the superintendent may
specify.

12. Powers and Duties of Deputy Superintendent
Inspectors
INSPECTOR. — The powers and duties given to
and imposed upon the superintendent by Sections 8, 9, 10,
and 11 of this Act are hereby given to and imposed upon
the deputy superintendent and inspector INSPECTOR
also, when acting under the instructions and at the direc-
tions of the superintendent.

13. City and County Sealers and Deputy Sealers of
Weights and Measures. —In and for each city or town hav-
ing a population of 35, 000 or more, and in and for each
county having a population of 35, 000 or more exclusive of
any city in such county having a population 35, 000 or more,
according to the latest official State or United States census,
there shall be a sealer of weights and measures, and such
deputy sealers of weights and measures as may be re-
quired, hereinafter referred to as sealers and deputy
sealers, respectively. The sealer and deputy sealers shall
be appointed by the governing body in any such town, city
or county in accordance with the local law as to such
appointments, subject to the approval of the superinten-

dent, to hold office during good behavior. A sealer or

deputy sealer shall not be removed, discharged, or reduced
in pay or position except for inefficiency, incapacity, con
-
duct unbecoming an employee or other just cause, and
until he shall have been furnished with a written state-
