ards of weights and measures and of the other standards
and equipment provided for by this Act, and shall keep
accurate records of the same. The superintendent shall
enforce the provisions of this Act, he shall have and keep
a general supervision over the weights and measures
offered for sale, sold, or in use in the State, and he shall
annually submit, not later than the 30th day of September,
a report of all the activities of his office during the previous
fiscal year to the Chairman of the State Board of Agricul-
ture for transmission to the Governor and Legislative
Council.
7. Specific Powers and Duties of Superintendent: Regu-
lations. —The superintendent shall issue from time to time
reasonable regulations for the enforcement of this Act,
which regulations shall have the force and effect of law.
These regulations may include (1) standards of net weight,
measure, or count, and reasonable standards of fill, for
any commodity in package form, (2) specifications and
tolerances for weights and measures of the character of
those specified in Section 9 designed to eliminate from use,
without prejudice to apparatus which conforms as closely
as practicable to the official standards, those which are
not accurate, which are of such construction that they are
faulty—that is, which are not reasonably permanent in
their judgment ADJUSTMENT or will not repeat their in-
dications correctly—or which facilitate the perpetration of
fraud, and (3) regulations governing the procedures to be
followed by city and county sealers of weights and meas-
ures in the discharge of their official duties. For the pur-
pose PURPOSES of this Act apparatus shall be deemed to
be correct when it conforms to all applicable requirements
promulgated as specified in this section; other apparatus
shall be deemed to be incorrect.
8. Same: Testing of Standards: Testing at State Sup-
ported Institutions. —The superintendent shall at least
annually test all weights and measures used in checking
the receipt or disbursement of supplies in every institution
for the maintenance of which monies are appropriated by
the legislature, and he shall report his findings, in writing,
to the supervisory board and to the executive officer of the
institution concerned. He shall test the standards of weight
and measure provided by any city or county for which the
appointment of a sealer of weights and measures is re-
quired by this Act, at least once every five years, and shall
approve the same when found to be correct, and he shall
inspect such standards at least once every two years.
