Court for Allegany County within thirty (30) days after
the filing of said decision by the Civil Service Commission
with the City Clerk. Upon the filing of such an appeal with
the Clerk of the Court for Allegany County, the Court shall
allow a Writ of Certiorari directed to the Civil Service
Commission to review such decision of the Commission and
shall prescribe therein the time within which return must
be made, to be not less than ten (1)0 days, but the time
may be extended by the Court. The return of the Commis-
sion shall precisely set forth the decision appealed from
and the grounds therefor and shall be verified. If it shall
appear to the Court that additional testimony is necessary
for the proper disposition of the appeal, it may take such
evidence as it may direct. THE COURT SHALL HEAR
THE PROCEEDINGS DE NOVO, SHALL THEREUPON
DETERMINE IN WRITING ALL MATTERS OF LAW
AND FACT AND SHALL RENDER ITS DECISION
EITHER APPROVING, SETTING ASIDE OR MODIFY-
ING THE ORDER COMPLAINED OF, AND THE
CLERK OF SAID COURT SHALL CERTIFY THE
SAME TO THE CIVIL SERVICE COMMISSION.
(2) Each person discharged for the purpose of reducing
the force and without fault upon his part shall receive a
certificate so stating and all persons so discharged shall
be placed on the eligible list in the order of the length of
their service and shall have preference over others on the
eligible list.
(3) In the case of any or all classes of seasonal or part-
time employees the Commission may, from time to time,
adopt, amend or rescind rules providing for their exclu-
sion from the application of the provisions of the preceeding
paragraph for placing the names of laid off employes on
eligible lists and for according preference to such em-
ployees over others on such lists, or rules limiting the appli-
cation of such provisions to such employees. No such rule,
shall, however, be adopted or amended so as to extend its
duration or the classes of employees covered thereby, except
after public notice and hearing, as provided, and upon
a finding of the Commission that the adoption of such a
rule or amendment will be in the public interest, which
finding, together with a statement of the reasons thereof,
shall be recorded in the minutes of the Commission and
included in its annual report.
(h) Classified Service--Roster of Employees. The
Civil Service Commission shall keep in its office an official
roster of the employees in the Classified Service, and shall
