herein provided, as the said Mayor and City Council may

require and confer upon him, not inconsistent with the
Constitution of the laws of this State, and the provisions
of this Act. In the case of absence, sickness or inability
to act as the Chief of Police, the Assistant Chief of Police
then becomes Acting Chief of Police during the period of
such absence, sickness or inability of said Chief of Police.

The Chief of Police shall furnish rules and regulations for
his department, covering conduct and standardized opera-
tion of same, rules and regulations, subject to the approval
of the Civil Service Commission.

(c) The Chief of the Fire Department shall be charged

with the duty of superintending and directing the extin-
guishment of fires, and preservation and safekeeping of
all fire engines, hose and other apparatus used in connec-
tion therewith; and it is hereby made his duty to keep
away from the vicinity of any fire, all idle and suspicious

and disorderly persons, and to compel all officers of the

City and all other persons to aid in the extinguishment of

fire and in the preservation of property exposed to danger

thereafter and in preventing goods from being stolen and

generally to carry out and enforce such regulations for the
prevention and extinguishment of fire as may be by said

Mayor and City Council deemed expedient. The Chief of
the Fire Department shall furnish rules and regulations
for his department,
covering conduct and standardized

operation of his department, rules and regulations, sub-

ject to the approval of the Civil Service Commission.

39. THE COMMISSIONERS SHALL CLASSIFY ALL
THE MUNICIPAL OFFICES AND POSITIONS IN THE
CITY OF CUMBERLAND TO WHICH APPOINT-
MENTS ARE MADE BY ANY PERSON OR PERSONS
WHO ARE, OR MAY BE, CLOTHED BY THIS CHARTER
OR ANY LAW OR ORDINANCE RELATING TO SAID
CITY WITH THE POWER OF MAKING APPOINT-
MENTS, EXCEPT THE POSITIONS OF CITY SOLICI-
TOR, SMOKE ABATEMENT ENGINEER, ASSISTANT
SMOKE ABATEMENT ENGINEER, RECREATION
DIRECTOR, AND HEALTH OFFICER. THE OFFICES
AND PLACES SO CLASSIFIED BY THE COMMISSION
SHALL CONSTITUTE THE CLASSIFIED CITY SERV-
ICE OF CUMBERLAND, AND NO APPOINTMENT TO
ANY OF SUCH OFFICES OR PLACES SHALL BE
MADE EXCEPT UNDER AND ACCORDING TO THE
RULES HEREIN MENTIONED AFTER THE PROMUL-
GATION THEREOF.
