any part of the powers herein provided for, and if any
of the provisions of this Act shall be held unconstitutional
by any court of competent jurisdiction, the decision of such
court shall not affect or impair any of the remaining pro-
visions of this Act. It is hereby declared to be the legisla-
tive intent that this Act would have been adopted had such
unconstitutional provisions not been included therein.
SEC. 16. And be it further enacted, That this Act shall
take effect June 1, 1951.

AN ACT to repeal and re-enact, with amendments, Sec-
tion 31 of Article 19A of the Annotated Code of Mary-
land (1939 Edition and 1947 Supplement), title "Con-
servation of Natural Resources, " so as to change the
title of "Executive Secretary" to "Director, "
SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 31 of Article 19A of the Annotated Code of
Maryland (1939 Edition and 1947 Supplement), title "Con-
servation of Natural Resources, " sub-title "Water Pollu-
tion Control Commission, " be and the same is hereby re-
pealed and re-enacted, with amendments, to read as fol-
lows:
31. (a) The present Executive Secretary of the Mary-
land Committee on Water Pollution may be appointed by
the Commission as its [Executive Secretary] Director to
hold office under the provisions of the Merit System Law
and thereafter any vacancies in this position shall be sub-
ject to the Merit System Law. The [Executive Secretary!
Director shall be a person with executive ability and ex-
perience and with knowledge of the general principles in-
volved in the investigation, administration and control of
the pollution of the waters of the State, shall perform such
duties as said Commission shall require of him in connec-
