Where any sheriff, deputy sheriff or

constable shall make an arrest on a ca-

pias issued by virtue of the act establish-

ing, &c. he may take a bond from the

the person or persons so arrested, in a

sum not exceeding $1 00, where the plea

of debt does not exceed $50, conditioned

for his or her appearance &c.
