1837.

said fund directly or indirectly, to his own advantage;
and the said levy court shall also require the said offi-
cer to give bond to the State of Maryland, with two
good and sufficient sureties, conditioned for the faith-
ful discharge of the duties required of him by law;
which bond, being approved by the levy court, shall
be filed with the clerk of Montgomery county court;
and any person or persons who deem him or them-
selves injured by the omission or acts of said treasur-
er, shall and may be entitled to an office copy thereof,
and bring suit thereon in the name of the State, for
his use, as in the case of administration or testament-
ary bonds; and a copy of said bond, under seal of
said court, shall be sufficient evidence of the making
thereof.

CHAP. 353.

Bond.

SEC. 2. And be it enacted, That the Treasurer of the
Western Shore, upon receiving a certificate of the ap-
pointment of said treasurer of the school fund, and his
qualifying according to law, from the levy court of
said county, shall pay over to the said treasurer, or
his order, annually, the dividends to which Montgom-
ery county is entitled on the several funds appropria-
ted to the purposes of education in this State.

SEC. 3. And be it enacted, That the levy court
aforesaid, at its next annual meeting, shall ascertain
and apportion the amount of the dividends payable to
said county annually among the several election dis-
tricts of said county, according to their free white po-
pulation; and the school commissioners of the several
election districts may draw on the treasurer of the
school fund of said county for their respective propor-
tions, to be applied by them to the purpose of educa-
ting the indigent children of their respective districts,
either according to the primary school system, or such
other system as the majority of the free white voters
of the several election districts choose to adopt.

SEC. 4. And be it enacted, That the several school
commissioners of Montgomery county, before procede-
ing to draw on the treasurer of said county for any
part of the fund payable to their respective districts,
shall give bond to the State, with security, for the
faithful discharge of their duties, to be approved by
the levy court: which bond shall be filed with the
