CHAP. 350.
Regiment of ar-
tillery.
|
SEC. 20. And be it enacted, That the first light bri-
gade of Maryland volunteers may be, and they are
hereby authorised to raise a regiment of artillery to
be attached to, and form a part of said brigade, and
the said regiment shall be subject to the same laws and
regulations as the other regiments composing said
brigade.

An act for the relief of the heirs of Thomas Hilleary,
late of Montgomery County, deceased.
|
|
|
|
Commissioners
to divide.
|
SECTION 1. Be it enacted by the General Assembly of
Maryland, That the partition heretofore made, by virtue
of commission issued out of the Chancery Court, for
that purpose, to divide the lands and real estate of
Thomas Hilleary, deceased, shall be as good and valid
in law as if all the lands therein contained, and men-
tioned, had been owned and held by the said Thomas

Return directed.

Hilleary in fee, and that the said commissioners re-
turn the same to Montgomery County Court, wherein
such proceedings shall and may be had for the ratifica-
tion and confirmation of the same, as if the said com-
mission had originally issued from said county court.

SEC. 2. And be it enacted, That the judges of Mont-
gomery county court, have as full power and authority
to hear and determine all questions arising upon said
commission and return, as if said commission had ori-
|
|
|
|

ginally been issued from said court, and all -parties
interested therein, feeling him, her, or themselves ag-
grieved, shall have the same right of appeal, as if the
same had originated therein; provided always, that it
shall be no objection to said partition that all the lands
were not owned and held by the said Thomas Hilleary,
in his own right, and in fee.

SEC. 3. And be it enacted, That if, for any cause, the
said county court, shall set aside the proceedings here-
tofore had, it shall be lawful for the said county court
to order a.new commission in the usual form, as if all
the said lands lay in said county, and were owned in
fee by said Thomas Hilleary, deceased; and the said
