CHAP. 335.

Proviso.

will be equitable, and so as to encourage the establish-
ment of schools as soon as may be in each district,
and may direct the agents accordingly; provided, that
the said court shall not apply or apportion, in any one
year, more than the sum received in the same year
from the Treasurer of the Western Shore, and the in-
terest of the school funds belonging to said county.

If not used.

SEC. 2. And be it enacted, That if any part of the
sum so apportioned, shall not be applied to the educa-
tion of such persons as are authorised by law to re-
ceive the benefit of said fund in any district to which
it may be apportioned, it shall revert to the free school
fund of said county, subject to the disposition of the
levy court, in the same manner as other free school
funds.

CHAPTER 335.

Passed Mar. 29,
1838.

An act relating to a Road proposed to be opened from
the Village of Frizzlesburg, on the Taney Town
Road, thence to Messenger's Mill, thence to Saint
Mary's Church, and thence to the Reisterstown Turn-
pike Road, at or near Joseph Keifer's Tavern, situa-
ted in Carroll County, and distinguished among the
Road Records in Frederick County, by number one
hundred and sixty-eight roads.

Carroll co.

Be it enacted by the General Assembly of Maryland,
That all the papers and proceedings now on file in the
office of the clerk of Frederick county, relating to a
road proposed to be opened and located from the vil-
lage of Frizzlesburg, on the Taney town road, thence
to Messenger's mill, thence to the Stone road, thence
to Saint Mary's Church, and thence to Reisterstown.

tuate in Carroll county, and distinguished by number
One hundred and sixty-eight on the road records of
Frederick county, be, by the clerk of Frederick coun-
ty, transmitted to the clerk of Carroll county, to bo
safely kept and preserved in his office, by the clerk of
Carroll county; and that the commissioners of the
tax of Carroll county, be, and they are hereby autho-
