same had been certified and recorded within the time
prescribed by law, any law usage or custom to the
contrary notwithstanding; provided this act shall not
affect the right of any bona fide purchaser without
notice or judgment creditor.

A further supplement to the act, entitled, an act to in-
vest the State's share of the Surplus Revenue of the
United States, and for other purposes, passed at De-
cember session eighteen hundred and thirty-six,
chapter two hundred and. twenty.

Payment autho-
rised to certain
counties.

Be it enacted by the General Assembly of Maryland,
That the Treasurer of the Western Shore be, and he
is hereby authorised and required to pay to the com-
missioners of Baltimore county, to the commissioners
of lax of Carroll county, and the levy court of Frede-
rick county, or to their orders respectively, the re-
spective portions of the proceeds of the surplus reve-
nue apportioned to said counties, by equal division of
the one half of the proceeds of the said surplus revenue
into twenty-one equal parts; and as the white popula-
tion of each of said counties is not known, the Trea-
surer is further authorised and required, any law to

time, as a joint fund, that portion being one-half of
the proceeds of the said surplus revenue apportioned
to said three counties according to their white popula-
tion, and the interest accruing on said investments in
such stocks or public securities as he may deem most
safe and lucrative, until after the promulgation of the
census of eighteen hundred and forty, when the fund
