CHAPTER 176.

CHAP. 176.

An act for the encouragement of Primary Schools in
Calvert county.

Passed Mar. 19,
1838.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the act, entitled, an act to provide
for public instruction of youth in primary schools
throughout this State, passed at December session,
eighteen hundred and twenty five, chapter one hundred
and sixty two, be, and the same is hereby extended to
Calvert county, and shall have effect and operation

in C. C.

therein, subject to the restrictions and qualifications
hereinafter mentioned.

Exceptions.

SEC. 2. And be it enacted, That the Orphans' Court
shall appoint three commissioners of primary schools,
in the several districts respectively, and in case of
any vacancy in the number of school commissioners,

for either of the said districts by death, removal, re-
signation or otherwise, the county commissioners shall
have, power to supply the said vacancy or vacancies,
until otherwise provided by law.

Case of vacan-
cy.

SEC. S. And be it enacted, That each of the said com-
missioners who may be appointed under the provisions
of this act, before proceeding to act in the discharge of
their appropriate duties, shall take the oath prescribed
by the section of the act of eighteen hundred and twen-
ty five, chapter one hundred and sixty two, or within
thirty days thereafter, and shall at any time within
thirty days thereafter, return a certificate thereof to

or return a certificate thereof, within the time or lim-
its herein before limited, he or they shall be subject
to the penalties prescribed by the said act of eighteen
hundred and twenty five for similar offences.

Case of failure.

SEC. 4. And be it enacted, That the school funds for
Calvert county arising under any and every act or re-
solution, and the avails of all investments for the sup-
port or encouragement of free or common schools in
said county, shall be placed under the direction and
control of the orphans' court in said county, and the
same as received by the said orphans' court from the
