execution.

An act to authorise the opening of a Bond through a
part of Baltimore and Carroll Counties, as therein
mentioned.

WHEREAS, it is represented to this General Assem-
bly, by the petition of sundry citizens of Baltimore
and Carroll counties, that the commissioners of Balti-
more county have heretofore appointed commissioners
to locate and open a road through said county, from a
point near Wooden's Tavern, on the Hanover Branch
of the Reister's Town turnpike road, to the Westmin-
ster Branch thereof, near Ely's mill: and whereas,
the said road cannot he conveniently located and open-
ed without passing a short distance through Carroll
county, without doing great injury to the head race of
said mill and inconvenience to the public as well as to
the proprietors: — Therefore,

SEC. 1. Be it enacted by the General Assembly of
Maryland, That John T. Moale and Eli Hinkle, of
Baltimore county, and Daniel Stull and John C. Kel-
ly, of Carroll county, he, and they are hereby appoint-
ed commissioners, who, or a majority of them, are
hereby authorised and required to survey, lay out and
open a road, not exceeding thirty feet in width, com-

mencing on the Hanover Branch of the Reister's town
turnpike road, at a point in said road about fourteen
perches distant from the southeast corner of the tavern
owned by Benjamin Wooden, and kept by Emanuel
Brough, and thence to intersect the north seventeen de-
grees, east line of Carroll county, near the northwest cor-
ner of the land owned by John Ely and brothers, and
thence through Carroll county, to the divisional line
between the lands of Mr. Gibbs and said Elys', and
thence to intersect the Westminster Branch of the
Reister's town turnpike road, at a point between the
twentieth mile stone, on said road, and Ely's mill,
near the said mill; provided, that the said commis-
