Sec. 2. And be it enacted, That nothing in this act
contained shall be construed to give the several sher-
iffs and collectors above named, any lien or preference
claim upon the estate of deceased persons, in preju-
dice of other creditors, but that the said sheriffs and
collectors in such cases shall only be entitled to a pro-
portion of assetts, if the assetts are insufficient to pay
all the creditors of the deceased.

An act to allow William Orrell, former Sheriff of Car-
oline county, further time to complete his collections.

Be it enacted by the General Assembly of Maryland,
That William Orrell, former sheriff of Caroline coun-
ty, and his deputies, or any agent by him appointed,
be and they are hereby authorised and empowered to
collect and receive, all and every balance or amount
of officers, fees, chancery taxes, and fines and forfei-
tures, and ail other sums that may be due and owing
to the said Orrell as Sheriff as aforesaid, or to his depu-
ties, in the same manner, and to the same effect as if the
term of office of the said Orrell as sheriff aforesaid, had

not expired; provided, that if any person against whom
there is a claim by said Orrell as sheriff as aforesaid,
or either of his deputies, shall make affidavit before a
justice of the peace of said county, thai the same has
been paid at any previous time, to any person authoris-
ed to receive the same, it shall prevent the said Orrell
and his deputies, from collecting said claim, in the
manner prescribed by law for collecting such claims;

and provided, also, that nothing in this act contained
shall be construed to affect the estate of a deceased per-
son, except to authorise the said Orrell or his deputies to
recover any claim on balance due by a deceased per-
son, in the same manner that claims against deceased

persons are now recovered by law: and provided also,
that this act shall only continue in force to the second
Monday in March, eighteen hundred and thirty nine.
