CHAPTER 107.

1838.

An act for the benefit of the Council of the Evangelic
Lutheran Church Emanuel, in and about Frederick
Town, in the State of Maryland.

Payment of le-
gacy authoris-
ed.

Be it enacted by the General Assembly of Maryland,
That Jacob Keller, the executor of the last will and
testament of Charles Yager, may, and he is hereby au-
thorised and empowered to pay and advance agreeably
to the said last will and testament unto the Council of
the Evangelic Lutheran Church Emanuel, in and about
Frederick Town, in the State of Maryland, the legacy,
devise and bequest given and bequeathed to thorn by the
said Carles Yager, in and by his last will and testament,
and also is authorised to permit them to take, have, use
and enjoy the same to every intent or purpose, agree-
ably to the said last will and testament; and that the
said Council of the Evangelic Lutheran Church Emau-
uel, in and about Frederick Town, in the State of
Maryland, be, and they are hereby authorised to take,
have and receive, and to demand, sue lor, and recover,
in any court of law or equity in this State, the said
bequest, gift and devise, made and given to them in
and by the said testament and last will of the said
Charles Yager.

CHAPTER 108.

1838.

An act to provide for the trial of the case of the Regents
of the University of Maryland, versus, the Treasurer
of said Institution, at the first term of the Court of
Appeals to which said case shall be taken.

Preamble.

WHEREAS, there is now pending in Baltimore coun-
ty court, an action brought by the Regents of the Uni-
versity of Maryland against Joseph B. Williams,
Treasurer of the Trustees of said University, to try
the constitutionality of certain acts of Assembly relat-
ing to said University; and whereas, it is of great im-
portance to the well being of said institution, and to
the public at large, that the questions involved in said
suit would be speedily settled—Therefore,
