thirty-nine, when the supervisor obtained leave from the levy
court of said county, to open the road on the original lo-
cation, which passes through the lands of the petitioner,
for which he has not received any compensation — there-
fore,

CHAP. 274.
|
|
|
SECTION 1. Be it enacted by the General Assembly of
Maryland, That the levy court of Frederick county, may
the location of said road; and the said commissioners by
this act appointed, shall value and ascertain the amount
of damages, if any, that the said George Blessing has
sustained by the said road known as number sixty-eight,
passing through his lands, taking into consideration the

advantages and disadvantages, if any; and the damages
so ascertained, shall be levied and assessed as other coun-
ty charges are.

SEC. 2. And be it enacted, That the compensation to
said commissioners shall not exceed two dollars per day,
for each day they are necessarily engaged, to be paid as
other commissioners are for similar services.

SEC. 3. And be it enacted, That nothing in this act,
shall be so construed as to require the levy court to ap-
point commissioners, unless they are fully satisfied that
justice requires it; and nothing shall be so construed as
to prevent either parly from appealing from the decision
of the commissioners, if appointed under the provisions
of this act.

WHEREAS, William Askey, Stephen Severson, Na-
thaniel J. Ellicott, Martin Mettee, Nicholas McCubbin,
Richard H. McMullen, William Coburn, Stephen F. Bur-
gess, John Johnson, John Sailor, John Askey, Allen
Burgess, Nathaniel Bramble, Samuel S. Barton, Richard
Hopkins, and others, have formed themselves into a so-
ciety for the laudable purpose of affording relief to each
other and their respective families in the event of sick-
ness and death, and have prayed an act of incorporation,
that they may the better execute their intentions; and the
