CHAPTER 207.

CHAP. 208.

An act to authorise George Thomas, of H. to cut down and,
sell certain timber standing on the farm devised to him in
trust, for the benefit of the wife, and children of Peter
L. Fout.

1840.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That George Thomas, of Henry, be and he is
hereby authorised to cut down and sell so much of the
timber now standing on the farm devised to him in trust,
by the last will and testament of Baltzer Fout, late of Fre-
derick county, deceased, as he may deem proper, not ex-
ceeding the quantity of twenty-five acres of the timber
land of said farm.

SEC. 2. And be it enacted, That the money arising from
the sale of said timber, after deducting therefrom all the
costs and charges necessarily incurred in cutting down and
selling the same, shall be paid by the said George Thomas
in satisfaction, pro tanto of the legacy of two thousand
dollars, given to Rebecca Grove by the said Baltzer Fout,

in his last will and testament; provided, the chancellor or
a county court as a court of equity, having jurisdiction in
the premises, shall upon proceedings filed for that purpose,
be of opinion, that the sale of said timber shall be to the
interest and advantage of the parties interested in said es-
tate; and the said chancery or equity court, are hereby au-
thorised to take cognizance of the subject, matter and de-
cree therein, as the interest of the parties interested may
require.

CHAPTER 208.

Proviso.

An act to provide for the erection of a Bridge over Chapti-
co Run, in Saint Mary's County.

1840.

WHEREAS, it appears by the memorial of sundry citi-
zens of Saint Mary's county, that the public convenience
requires the erection of a bridge over Chaptico run, in said
county— Therefore,

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the commissioners for Saint Mary's coun-
ty, be and they are hereby authorised, if in their judgment
they should deem it necessary and expedient,to levy upon
