LAWS OF MARYLAND.

CHAP. 68.

Sec. 10. And be it enacted, That each of the said
commissioners shall be entitled to receive two dollars
per day; for every day he shall necessarily attend to
the duties of his office.

time.

Sec. 11. And be it enacted, That the said commis-
sioners, shall and may at any lime during each and
every year, make, complete, and close their levy, any
law to the contrary notwithstanding; and that all suits

at law, and in equity, which may be pending at the
time of the passage of this act, by or against the jus-
tices of the levy court of said county, shall be carried
on in like manner, and have the same legal effect, ei-
ther in favor of or against the commissioners provided
for by this act, as if such suit or suits had been insti-
tuted by or against the said commissioners.

Acts inconsistent
herewith repealed.

Sec. 12. And be it enacted, That so much of any
acts of Assembly, as may be contrary to, or inconsist-

ent with the provisions of this act, be, and the same

are hereby repealed.

Case of tie at elec-
tion.

Sec. 13. And be it enacted, That in case of a fail-
ure to elect a commissioner in any of the said districts,
by reason of a tie, it shall be the duty of the Sheriff of
St. Mary's county, upon receiving official information

of the fact from the clerk of said county, to appoint a
day for holding a new election for commissioner from
said district, upon at least ten day's notice, exclusive of
the day of holding such election; and the judges of
election for said election district, shall hold the same,
under the regulations hereinbefore provided, for the
regular election of commissioners for said county, and
make their returns in the same manner.

CHAPTER 68.

Passed Feb. 22,
1839.

An act for the benefit of Richard R. Waters, late sheriff
of Montgomery County.

May collect dues
till March, 1840.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That Richard R. Waters, late sheriff of
Montgomery county, be and he is hereby authorised
to collect until the first day of March, eighteen hun-
dred and forty, all fines, forfeitures, amerciaments,
officers fees, and public dues, which were placed in his
