the act of 1835, ch. 200, relating to,

In case of free negro or mulattoe con-

vict being ordered to be sold out of the

State, under the original act, there shall

be allowed by the sheriff, &c. making said

sale, out of the proceeds, to the officer ap-

prehending, prosecuting &c., one-fourth

of the proceeds of the sale — the balance

he shall pay to the State treasury,

Penitentiary, if any he due, if not, then
