be built, and take stone, gravel or sand, necessary for building, repairing or rebuilding, said bridge, first
giving notice thereof to the owner of the land, and doing as little damage as possible, and repairing any
breaches made in enclosures, and making amends for any damage by agreement, if the parties can agree, if
they cannot agree, or if the proprietors be minors, femes-covert or insane, a jury of disinterested freeholders
may be summoned, at the instance of either party, by the sheriff of the county where the lands lies, to view
the said damage, and upon oath, or affirmation, to value the same, of the meeting of which jury ten days
notice at least shall be given to the opposite party, and so proved to the satisfaction of the jury, before they
proceed to such valuation, and the same, when made so as aforesaid, shall be final.

CHAP.
CXI.

XIII. AND BE IT ENACTED, That the said president and directors may contract for, and hold as afore-
said, a lot or lots of ground on each side of said river, not exceeding twenty acres, for the purpose of fur-
nishing at all times a supply of building stone, sand and gravel, for the use of said bridge.

XIV. AND BE IT ENACTED, That in consideration of the risk and expense to be incurred by the said com-
pany in erecting the said bridge or bridges, and keeping the same in repair, the said bridge or bridges, and
all the profits of the same, shall be and hereby are vested in the president and directors aforesaid, and their
successors, to and for the use and benefit of the stockholders aforesaid, in proportion to their respective shares
of stock in the said company, and the same shall be and remain exempt from any tax or appraisement what-
ever.

' XV. AND BE IT ENACTED, That it shall and may be lawful for the said president and directors for the
time being, to demand and receive tolls at the said bridge not exceeding the following rates, which tolls shall
not be altered oftener than once a year, and those payable shall not at all times be made public at the said bridge,
to wit: For every coach, chariot, phaeton, stage, or other carriage of pleasure, drawn by four horses, with
four wheels, one dollar and firry cents; for the like carriages with two horses, one dollar; for a wagon with
four horses, one dollar; for a wagon with two horses, seventy-five cents; for a chaise, riding chair, gig,
cart, or other two wheeled carriage, with two horses, sixty-two and one half cents; for the like carriages,
with one horse, fifty cents; for one horse, and rider, twenty-five cents; for a single horse or mule, twelve
and one half cents; for every foot passenger, six and one quarter cents; (for every head of horned cattle, six
and one quarter cents; for every sheep and hog, three and one eighth cents; and for all such carriages drawn
by oxen in the whole, or partly by horses and partly by oxen, two oxen shall be estimated as equal to one
horse, and every mule as equal to one horse, in the charge of said tollage.

XVI. AND BE IT ENACTED, That at the end of every half year after the said bridge shall be erected, the
president and directors aforesaid for the time being, shall make and declare dividends of the tolls or profits
arising therefrom amongst the several stockholders in the said company, in proportion to their respective
shares of stock, and shall pay over such dividends, when demanded, to the person or persons entitled to the
same.

XVII. AND BE IT ENACTED, That all the powers and duties herein before given to or imposed upon the
president and directors aforesaid shall and may be exercised and performed by a majority of them.

XVIII. AND BE IT ENACTED, That the assent of this state be and the same is hereby given to the
United States to take and hold stock in the said company, and to subscribe for the same in such manner as
they may direct and appoint.

CHAP. CXII.

Assent of the
state given, &c.

An ACT to make public the road therein mentioned.

BE IT ENACTED, by the General Assembly of Maryland, That the road which leads from Thomas
Wells's by the Windsor mills, until it intersects the White Ground road, shall be extended of
the width of thirty feet, and shall be opened under the direction of the commissioners herein after
mentioned; and the said road, when so opened, shall thereafter be deemed and taken as a public
road, and as such be used by all persons passing that way.

II. AND BE IT ENACTED, That the said road shall be widened and hereafter kept in repair by
the persons interested therein.

III. AND BE IT ENACTED, That Job Smith, John Hasslebaugh and John M'Clellan, be and they
are hereby appointed commissioners to ascertain the sum which each person shall pay for widening
and keeping the said road in repair, and the decision of the said commissioners, or a majority of
them, shall be binding upon the persons benefitted by said road; and when the said commissioners,
or a majority, shall so decide, the sum adjudged by them to be paid by the several persons interested
