transfer the fee-simple of the said land to the said Littleton D. Teackle, as if he the said John
Campbell had been at the time of the making thereof, a full and perfect citizen of the United States
and the state of Maryland, and that the said deed from Littleton D. Teackle and John Teackle,
shall be deemed and taken as effectual to transfer the fee-simple in the said land to the said Crockett,
as it would have been had the said Campbell been a full and perfect citizen of the United States and
the state of Maryland at the time of making the said de. ed to the said Littleton D. Teackle.

An ACT authorising a lottery to erect suitable buildings for a school-
house for the accommodation of the youth of Emmitsburgh, and
its vicinity, in Frederick county,

Passed 24th of
Dec. 1808.

BE IT ENACTED, by the General Assembly of Maryland, That it shall and may be lawful for Philip
Nunamaker, Lewis Motter, Lewis Weaver, James Hughes, William Emmitt, Henry Williams
and John Huston, or a majority of them, to propose a scheme of a lottery for raising a sum, not ex-
ceeding twelve hundred dollars, and to sell the tickets in said lottery, provided they, or a majority
of them as shall undertake to act under this law shall, before the sale of any ticket or tickets in said
lottery, give their bond to the state of Maryland, in the penalty of two thousand five hundred dol-
lars, conditioned that they will well and truly apply so much of the money arising therefrom, within;
twelve months after the completion of the drawing of said lottery, as will satisfy the fortunate ad-
venturers for prizes drawn by them, and after deducting the necessary expenses incurred in said
lottery shall, within eighteen months after the lottery is drawn, apply the money raised by such lot-
tery for the purpose of erecting suitable buildings for a school-house in or near the town of Emmits-
burgh.

A scheme may
be proposed,

II. AND BE IT ENACTED, That it shall be the duty of the said commissioners, before they act as
such, to lodge the bond made and entered into as aforesaid in the office of the clerk of Frederick
county court, there to be recorded, and upon such bond, or any office copy thereof, suit or suits may
be instituted against the obligors therein, or any of them, of their legal representatives, for any
breach or noncompliance with the conditions of the same.

CHAP. CIII.

Bond to be
lodged, &c.

An ACT for the relief of Nancy Gaither, Sarah Gaither and Mary
Gaither, of Anne-Arundel county.

Passed 34th of
Dec. 1808.

WHEREAS it is represented to this general assembly, by the petition of Nancy Gaither, Sarah
Gaither and Mary Gaither, of Anne-Arundel county, that a law passed im the year one thou-
sand seven hundred and ninety-three, chapter thirty-eight, entitled, An act to appoint commission-
ers to straighten and amend the roads therein mentioned, and for other purposes, under the authority
of which law the commissioners therein named proceeded to lay out the road from Elk-ridge Landing
by Owing's mill, and intersected Ellicott's road at the west end of the petitioner's land, which, if
opened, will materially injure their property, in as much as there will be two roads running through
their lands nearly parallel: And whereas the petitioners aforesaid have requested this general assem-
bly to pass a law authorising commissioners to lay out the said road so as to intersect Ellicott's road
at the mouth of their lane, at the east end of their dwelling; and the prayer of the petitioners ap-
pearing reasonable, therefore,

Preamble.

II. BE IT ENACTED, by the General Assembly of Maryland, That Thomas Worthington, of Nicholas,
Vachel Burgess and Henry Griffith, or any two of them, be and they are hereby appointed commis-
sioners, with fall power and authority to confirm, alter or change the aforesaid road.

Commissioners,
appointed, &c.

III. AND BE IT ENACTED, That the said commissioners, or a majority of them, shall ascertain
and value what damages may be sustained by any person or persons through whose lands the said
road, if altered or changed, may pass, taking into consideration the advantages or disadvantages, if
any, and the same, when so assessed, shall be paid, or secured to be paid, by the said Nancy Gai-
ther, Sarah Gaither and Mary Gaither, to the person or persons entitled to receive the same, before
the said road, after it is laid off, shall be opened and cleared; provided, the said road shall not be
opened through the gardens, yards or orchards, of any person, without his or her consent.

Damages to be
ascertained,
&c.

IV. AND BE IT ENACTED, That all costs and charges which may attend the altering, laying out
and opening, the said road, shall be at the expense of the petitioners.
