1807.

of the last will and testament of John Gunby, late of Worcester county, deceased, to Edward
Henry aforesaid, be and the same is hereby confirmed and rendered valid; and that the said execu-
tors be and they are hereby authorised and required, upon having the purchase money secured ac-
cording to the said last will and testament, to transfer and convey, by deed of bargain and sale, the
said lands to the said Edward Henry, his heirs and assigns, containing a clause of special warranty
against themselves and all claiming under them, and against the heirs or representatives of the said
John Gunby, deceased, which said deed shall bar and destroy all right of the heirs of said Gunby
in and to the said lands, notwithstanding the aforesaid mistake in the description thereof in the said
last will and testament.

An ACT for the preservation of the navigation of Cabbin creek, in
Dorchester county.

Passed 20th of
January, 1808.

WHEREAS it is represented to this general assembly, that wears have of late been erected in
and upon Cabbin creek, in Dorchester county, to the great injury of the Navigation of the
said creek; therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That all wears already made, or hereafter
to be made, in and across the channel of the said creek, so as to stop up the passage of boats or ves-
sels, shall be deemed and are hereby declared nuisances, and may be by any person taken out of said
Cabbin creek and destroyed as such.

III. AND BE IT ENACTED, That no person or persons shall, after the first day of March next,
put, place or make, any wear, in and across the channel of the said creek, so as to stop the passage of
boats or vessels, under the penalty of twenty dollars current money for every such offence, to be
recovered before a single magistrate in the same manner as small debts are recovered, and appropri-
ated, one half to the informer or person who will sue for or prosecute to effect for the same, the
other half to the use of Dorchester county, any law to the contrary notwithstanding.

CHAP. CXL.

No person to
make wears,
&c.

An ACT to increase the powers of the high court of chancery.

WHEREAS it is represented to this general assembly, that the court of chancery has not the
power to decree against parties who have been directed to produce books relative to disputes
in said court, and who have neglected or refused to comply with such direction; therefore^

II. BE IT ENACTED, by the General Assembly of Maryland, That in any case where the chancellor
has ordered, or may order, the production of books in the possession of any party in the said court,
on the failure of such party to produce such books, so directed to be produced, by the day therein
limitted, or to shew sufficient cause for such failure, during the first four days of the succeeding
term, or any other term that may be appointed therefor, the chancellor may, in his discretion, take
the allegations in the bill of complaint of the party requiring the production of the said books, pro
confesso, and decree ex parte in such manner as shall appear just and reasonable,

A Supplement to an act, entitled, An ad to establish a bank, and
incorporate the subscribers thereto.

WHEREAS doubts are entertained whether the directors appointed on the part of this state
in the Bank of Baltimore are entitled to the same rights, powers and privileges, with the
directors chosen by the stockholders in the said bank; therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That the directors appointed on the part
of this state shall have and enjoy all the rights, powers and privileges, which are possessed by the
directors chosen by the stockholders of said bank.

A Further supplement to the act, entitled, An ad relating to the
public roads in Queen-Anne's county.

BE IT ENACTED, by the General Assembly of Maryland, That from and alter the first Monday in
April next, each and every person appointed a supervisor of any road in Queen-Anne's county,
