CVII.

CHAP. CVIII.

January, 1808.

An ACT to authorise the levy court of Anne-Arundel county to assess
and levy a sum of money for the purposes therein mentioned.

Coun to levy
money, &c.

BE IT ENACTED, by the General Assembly of Maryland, 1 hat the levy coun of Anne-Arundel coun-
ty be and they are hereby authorised and required, annually to levy on the assessable property
in said county, a sum of money not exceeding fifteen hundred dollars, to be applied to the pay-
ment and discharge of the expenses incurred by the attendance of jurymen at Anne-Arundel county
court.

To be deposit-
ed in the Far-
mers Bank, &c.

II. AND BE IT ENACTED, That the said sum of money, when so levied and collected, shall, by
the said justices, be deposited in the Farmers Bank of Maryland, and a certificate, signed by the
clerk of the county court, expressing the number of days which any juryman may have attended,
and the sum due to him for such attendance, shall be a sufficient authority to the cashier of the said
bank to pay the amount so specified in the said certificate.

Justices to set-
tle, &c.

III. AND BE IT ENACTED, That the said justices of the levy court shall, annually, settle and
balance their account with the said bank, and the surplus, if any, to be applied by the said justices
to the use and benefit of the said county.

And defray the
allowance to
jurymen, &c.

IV. AND BE IT ENACTED, That until the said sum of money shall be so as aforesaid levied and
collected, the justices of the levy court of the said county shall and they are hereby authorised to
defray the allowance of jurymen of the said county court, out of the money belonging to Anne-
Arundel county, deposited in the Farmers Bank -of Maryland, to be drawn therefrom by a certifi-
cate, signed by the clerk of 'the county, in the manner above directed.

CHAP. C1X.

Passed 20th of
January, 1808.

An ACT to confirm and make public a certain road therein men-
tioned.

Preamble.

WHEREAS by an act, passed at the last session of assembly, entitled, An act to lay out and
straighten a road from Towson's tavern, on the Baltimore turnpike road, to intersect the
Pennsylvania line at major David Wiley's, certain commissioners were appointed, authorised and
required, to view and lay down a correct plot of the road therein mentioned, in the nearest and best
direction, and on the best ground, and make return thereof to the next general assembly, which
being done, and it appearing that the said road will be of public convenience and advantage if car-
ried into effect; therefore,

Plot confirmed,
&c.

II. BE IT ENACTED, by the General Assembly of Maryland, That the plot and survey of the said
road, so as aforesaid laid out by the said commissioners, shall be and the same is hereby confirmed;
provided, that such road, in the estimation of a majority of the levy court of each county, shall be
considered as useful and necessary, and in such case the said road, or such part thereof as shall be
agreed to by a majority of the levy court of each county, is hereby declared to be a public road, and
shall be kept in repair by the said counties of Harford and Baltimore respectively, as other public
roads in said counties are kept in repair by them; and the levy courts of each of the said counties
are authorised and empowered to levy and assess a sum of money, such as in their opinion will be
sufficient to clear and open the said road, so far as the same may run in either county, and to appoint
an overseer or overseers to open said road.

III. AND BE IT ENACTED, That the commissioners aforesaid are hereby required to make out a
plot of said road so far as the same may run in Baltimore county, and another plot of said road so
far as it may run in Harford county, under their hands and seals, and make return thereof to the
respective county courts, there to be recorded among the land records of said counties.

Allowance to
overseers

IV. AND BE IT ENACTED, That the overseer or overseers appointed by either of the levy courts
upon or over the said road, shall be entitled to the same allowance for their services as other over-
seers in said counties respectively may be entitled to.
