NOVEMBER. LAWS OF MARYLAND.

 

CHAP. LXXI.

Passed 20th of
January, 1808.

An ACT to encourage the destruction of crows in the several coun-
ties therein mentioned.

Persons to be
allowed for
crows heads,

&c.

BE IT ENACTED, by the General Assembly of Maryland, That if any person residing in Prince-George's,
Caecil, Anne-Arundel, Saint-Mary's, Calvert, Charles, Baltimore, Kent and Worcester counties,
shall bring to any justice of the peace of the county in which such person shall reside, the head er
heads of any crow or crows, such person shall for every such head be allowed, in the county levy of
said county, the sum of twelve and an half cents, and the justices of the peace before whom such
head or heads shall be brought, are hereby required to give the person bringing the same a certificate
thereof, and cause the said head or heads to be burnt or otherwise destroyed.

Proviso.

II. PROVIDED NEVERTHELESS, AND EE IT ENACTED, That no person whatsoever shall be entitled
for any allowance for any such head or heads without first making oath, or affirmation, as the case
may be, that such crow or crows was or were killed in the county where such certificate is applied
for, and that no certificate is applied for, and that no certificate hath been obtained from any other
justice of the peace for the same; and that it shall be the duty of each and every justice of the peace
before whom such head or heads may be brought, by virtue of this or any other act now existing for
the destruction of crows, to take and receive the oath or affirmation o! the party bringing the same,
free and clear from all charges against the person or persons making such oath or affirmation., any
thing in any law to the contrary notwithstanding.

Acts repealed.

III. AND BE IT ENACTED, That all acts relative to the destruction of crows in the several coun-
ties herein mentioned, heretofore passed, be and the same are hereby repealed.

CHAP. LXXII.

Passed 20th of
January, 1808.

An ACT to lay out and make public a road therein mentioned in
Harford county.

Preamble.

WHEREAS it is represented to this general assembly, by the petition of sundry inhabitants of
Harford county, that a public road laid out from James M'Comas' saw mill, to intersect the
post-road leading from Baltimore to Havre-de-Grace at or near Onion's works, on the Little Falls
of Gunpowder, would be of great public utility; therefore,

Commissioners
appointed, &c.

II. BE IT ENACTED, by the General Assembly of Maryland, That William Wilson, John Weston and
James Amos, be and they are hereby appointed commissioners, and they, or a majority of them, are
authorised and empowered to review the old private road leading from James M'Comas' saw mill, in
Harford county, by John Devin's, to the post-road leading from Baltimore to Havre-de-Grace, at or
near Onion's works on said road, and to lay out, survey, mark and bound the same, not exceeding
thirty feet in width, and to make a plot of said road when laid out, surveyed, marked and bound,
and return such plot, under their hands and seals, to the clerk of Harford county, to be by him re-
corded among the land records of the county.

Court to ap-

visor, &c.

III. AND BE IT ENACTED, That the levy court of Harford county, at any meeting after the said
plot shall have been recorded, are hereby authorised and empowered to appoint a supervisor to open,
clear and repair, the said road; and the said levy court are hereby further authorised and empower-
ed to levy and assess upon the assessable property of said county, a sum of money in their opinion
sufficient to survey, open and clear said road; and the said road, when surveyed, opened and clear-
ed, shall be a public road, and shall thereafter be kept in repair as other public roads in said county
are kept in repair; provided, that the said road shall not be hid through the lands of any person or
persons unless the consent of such person or persons be first had and obtained in writing.

Commissioners
allowance, &c.

IV. AND BE IT ENACTED, That the commissioners aforesaid shall be and they are hereby entitled
to receive two dollars each for every day they shall respectively attend to the discharge of the duties
required by this act, and the levy court are hereby empowered to assess and levy the same as other
public monies are levied and assessed.

WHEREAS it has been. represented to this general assembly, by the petition of Mary Gwinn,
