CHAP.

LXIII.
H. Leatherbury
may collect, &c.

II. BE IT ENACTED, by the General Assembly of Maryland, That the said Robert Leatherbury be
and he is hereby authorised to collect, until the first day of October, eighteen hundred and eight,
all balances due him, as sheriff of Somerset county, for the year eighteen hundred and six, in the
same manner as he could or might have done within the time limitted by law, any law to the con-
trary notwithstanding.

To deliver an
account, &c.

III. AND BE IT ENACTED, That it shall be the duty of the said Robert Leatherbury, before he
proceeds to execute or distrain the property of any person or persons for taxes or public dues in
virtue of this act, to deliver to such person or persons chargeable with the same, at least thirty
clays previous to the levying such execution or distress, an account, written in words at full length,
of the taxes demanded of him, her or them, with an affidavit annexed, if required, that he hath not
received any part thereof, nor any thing as security or satisfaction for the same, more than credit
given, to the best of his knowledge.

Books to be
lodged, &c.

IV. AND BE IT ENACTED, That the said Robert Leatherbury, before he derives any benefit from
or under this act, shall lodge a copy of his collection books in the sheriff's office of Somerset coun-
ty, to be open for the inspection of all persons interested in the same.

CHAP. LXIV.

Passed 20th of
January, 1808.

An ACT to provide for recording certain wills in the register's office
of Worcester county.

Preamble.

WHEREAS it is represented to this general assembly, by the petition of the register of wills
of Worcester county, and certified by the orphans court of said county, that a number of
wills, anterior to the division of Somerset, and erection of Worcester county aforesaid, are in a
ruinous and imperfect state, and that a new record, made from the original wills in the said office,
would be of great utility; therefore,

Certain wills to
be recorded,
&c.

II. BE IT ENACTED, by the General Assembly of Maryland, That it shall and may be lawful for the
justices of the orphans court of Worcester county, and they are hereby empowered and required, to
cause to be recorded by the register of wills of said county, in good leather bound books, to which
fair and regular alphabets shall be prefixed, all such wills filed in the office of the register of wills
of said county, and which have not been recorded, as they, or a majority of them, in their judge-
ment, may deem necessary and proper to be recorded.

Register's fees.

III. AND EE IT ENACTED, That the said register shall be entitled to receive ten cents per side for all
such wills by him recorded as above required, as a compensation for his services for recording the same.

To be levied on
the county, &c.

IV. AND BE IT ENACTED, That the levy court of Worcester county may and shall levy on the
assessable property of said county, such sum of money as the fees for recording said wills may amount
to, to be collected and paid over by the sheriff of Worcester county to the register aforesaid.

Duration!

V. AND BE IT ENACTED, That this act shall continue in force until the first day of May, eighteen
hundred and eleven, and no longer.

CHAP. LXV.

Passed 20th of
January, 1808.

An ACT authorising Benjamin Ray, late sheriff and collector of
Montgomery county, to complete his collection.

Preamble.

WHEREAS it is represented to this general assembly, by the petition of Benjamin Ray, late
sheriff and collector of Montgomery county, that from various causes therein set forth he
has not been able to complete his collection within the time limitted by law, and there is still due to
him, as sheriff and collector of said county, considerable sums of money, and praying a law may pass
to enable him to collect the same; therefore,

B. Ray may
collect, &c.

H. BE IT ENACTED, by the General Assembly of Maryland, That the said Benjamin Ray be and he is
hereby authorised and empowered to collect, until the first day of October, eighteen hundred and
eight, all balances due him, as sheriff and collector of Montgomery county, for the year eighteen
hundred and six, in the same manner as he could or might have done within the time limitted by
law, any law to the contrary notwithstanding.
