that he or she believes the same to be unjust, or that the
same had been paid at any previous time, to the person
claiming the same, it shall forever bar such claims, and

provided, that nothing in this act shall be construed to effect
the estate of any deceased person, and provided also, that
this act shall only continue in force for one year from its
passage.

CHAPTER 46.

 

An act to allow Henry Harding, of Montgomery County,
late sheriff and collector, further time to complete his
collections.

Passed Jan.
28, 1844.

Section 1. Be it enacted by the General Assembly of
Maryland, That Henry Harding, late sheriff and collector of
Montgomery county, by himself or any person or persons by
him appointed for this purpose, is and are hereby authorised
and empowered to collect, until the. last day of December,
eighteen hundred and forty-five, all sums and balances due
him as sheriff and collector of Montgomery county, in the
same manner which the said Henry Harding could or
might have done within the time limited by law, any thing
to the contrary notwithstanding.

Time exten-
ded.

Sec. 13. And he it enacted, That it shall be the duty
of the said Henry Harding, before he proceeds to
execute or distrain the property of any person or persons
for taxes, public dues or officers fees, in virtue of this act,
to deliver to such person or persons chargeable with the
same, at least thirty days previous to the levying such
execution or distress, an account written in words in full
length, of the taxes, public dues or officers fees demanded
of him, her or them, with an affidavit annexed thereto, that
he hath not received any part thereof, nor any thing in
security or satisfaction for the same, more than the credits

given, to the best of his knowledge, provided that no per-
son shall be required to pay any taxes under this act, who will
make oath before a justice of the peace, that the taxes or
fees claimed have been paid, or where the person is dead,
if the heir, executor or administrator or assignee will make
oath as aforesaid, that he or she believes the said taxes
have been paid.
