FRANCIS THOMAS, ESQUIRE, GOVERNOR.

CHAP. 320.

assess and levy any sum or sums of money on the inha-
bitants or owners of property in said town, for the pur-
pose of grading, paving or otherwise improving the
streets, lanes or alleys or either of them, in said town, or
for any purpose for which the said Mayor and Council-
men are now by law authorized to assess and levy, the
sum or sums of money which may hereafter be, by the
said Mayor and Councilmen assessed and levied, shall be,
and are hereby declared to be a lien on the lot or lots on
which the same may be levied, or which may be owned
by the person or persons upon whom or upon whose pro-
perty the said assessment or levy shall be made until the
same shall be paid, and in case the said sum or sums of mo-
ney so assessed and levied, shall remain unpaid for the
space of sixty days after the same shall be payable, and
there shall be no personal property in said town on which
the warrant in the nature of a fieri facias can be levied as
directed by the act to which this is a supplement, belong-
ing to the owner or owners of said property, it shall be
lawful to levy the said warrant upon so much of the said
property as shall in the opinion of the said Mayor and
Councilmen be sufficient to pay the said sum or sums so
levied as aforesaid, which said part or parts of said pro-
perty shall be laid off by said Mayor and Councilmen,
and the bailiff making said levy, shall upon giving twenty
days notice in one or more newspapers printed in said
town of the manner, time and place of said sale, shall
sell the said part or parts so laid off as aforesaid at public
auction to the highest bidder for cash, and after deducting
the expenses of said sale and paying the sum or sums so
levied as aforesaid, shall pay over the balance, if any, to
the owner of said property, and the said Mayor and
Councilmen or a majority of them, are hereby authorized
and required to execute and deliver to the purchaser or
purchasers of said part or parts so sold as aforesaid, a
deed of bargain and sale for the same, with the seal of
said corporation affixed, which shall be good and valid to
transfer the title to the purchaser or purchasers as afore-
said, of the part or parts so sold as aforesaid.

Bailiff to have
full power to
make collecti-
ons.

Sec. 3. And he it enacted, That the bailiff of the
said corporation shall have full power to make all collec-
tions required of him at any time within the year for
which he was appointed bailiff.

Elections to
be held by
Mayor and
Councilmen.

Sec. 4. And be it enacted, That the elections for Mayor
and Councilmen shall hereafter be held by the said May-
or and Councilmen at the council chamber in said town,
instead of the court house, on the second Monday in
May in each and every year, and it shall be the duty of
