A further supplement to an act entitled, an act to incorporate
a company for the purpose of cutting and making a
Canal between the river Delaware and the Chesapeake bay.
|
Preamble.
|
Whereas, by the- original act to which this is a sup-
plement, no authority was given the Chesapeake and
Delaware Canal Company to charge toll per capita upon
passengers; and whereas it will be advantageous to the
public interest and at the same time beneficial to said
|

its acceptance

company to have such a right—Therefore,
Section 1. Be it enacted by the General Assembly of
Maryland, That whenever the Chesapeake and Delaware
Canal Company, by a regular vote of its stockholders
shall signify to the Secretary of State in writing, under
its corporate seal, the acceptance of the terms of this
act, it may be lawful for said company to charge for and
in respect of each and every passenger conveyed through
said canal, in any kind of vessel, whether owned by
said company or by any other proprietor or proprietors,
a toll of twenty five cents in lieu of the four dollars now

allowed on boats not having commodities on board; pro-
vided, the maximum charge for children under twelve
years of age shall not be more than half that sum; and
in case of a refusal by any passenger passing through
said canal, to pay the said toll, the said company shall
have the same remedy to enforce its payment, as is pro-
vided for in the tenth section of the original act to which
this is a supplement; provided, that all boats regularly
engaged in conveying passengers shall be allowed to
pass through said" canal at a speed which shall not be
restricted by said company to a less average rate than
four miles an hour; and provided further, that all boats,
whether propelled by steam or other power, regularly
engaged in the transportation of passengers upon said
canal, shall be entitled to a preference over freight and

other boats, in passing through the locks of said canal.
Sec. 2. And be it enacted, That each and every pas-
senger passing through the canal, shall be allowed to
carry seventy five pounds of baggage, without any charge
of toll by the said company directly or indirectly on said
baggage; and upon any other baggage, owned by any
passenger on board any such boats or other conveyances,
over seventy-five ponnds, the said company may charge
at the same rate, and no more, as it may now charge for
merchandize passing through said canal.
