CHAPTER 270.

A further supplement to the act entitled, an act to incor-
porate the Town of Emmittsburg, in Frederick county.

Preamble

Whereas, the citizens of Emmittsburg neglected to
elect a burgess and commissioners on the first Monday of
April last as required by the original act—Therefore,

Incorporated.

Section 1. Be it enacted by the General Assembly of
Maryland, That the free white male citizens of Emmitts-
burg aforesaid, of the age of twenty one years and up-
wards, and having resided twelve months in said town
next preceding the election, be authorized to elect on the
first Monday of May, in the year eighteen hundred and
forty-four, and on the same day annually forever thereaf-

ter; provided, a majority of the voters at the first election
to be held under this law, shall signify their consent to
the incorporation of said town, and for the purpose of
ascertaining whether a majority of the votes of said town
are in favor of this act, the judge holding said election
shall enquire of each voter, as he may come to cast his
ballot, whether he is for or against the incorporation of said
town, and shall make a return of the respective number
of votes cast for or against the same to the clerk of Fred-
erick county court, and if a majority of the voters shall
declare themselves in the manner provided by this provi-
so, in favor of this act, then this act, shall have full force
and effect; or otherwise be null and void, a burgess and
six commissioners for the said town, who shall be inha-
bitants thereof, above twenty-five years of age, and hold-
ing real property in said town, and the burgess and com-
missioners of the said town to hold their office until suc-

Sec. 2. And be it enacted, That a justice of the peace
for the time being residing in said town, shall appoint by
writing under his hand and seal one Judge to hold the
election for burgess and commissioners as directed by the

Sec. 3. And be it enacted, That for the recovery
of fines and forfeiture, under the ordinances of said cor-
poration, the burgess may commit persons offending
against the ordinances of said corporation (in case the
said offender or offenders shall neglect or refuse to pay the
fine or penally imposed by said burgess under the ordi-
nance) to the county jail and that the constable appoint-
ed by the said corporate authorities, shall and may have
power to deliver such person or persons so committed to
the sheriff of the said county, whose duty it shall be to
