be appraised, by two disinterested persons, one of whom
shall be chosen by each party, and if they cannot agree,
they are hereby authorized to choose a third person to
decide between them, the said damages to be recovered,
before any justice of the peace in and for Allegany coun-
ty in the same manner as small debts out of court are
now recovered.

CHAP. 141.

SEC 3. And be it enacted, That if either party shall
neglect or refuse during the space of five days after no-
tice of such injury to or impounding of such horned or
black cattle, sheep or hogs, then the justice of the peace
to whom complaint shall be made by the party aggrieved,
shall have authority to appoint an appraiser for and on
behalf of the party so neglecting or refusing.

CHAPTER 141.

 

An act for the relief of Joseph Richardson, Clerk of
Caroline county court, and for the benefit of all persons
concerned in the records of said court, which may have
been lost or stolen from the office of the said clerk.

17, 1844

Whereas it has been represented to this general as-
sembly by the memorial of Joseph Richardson, clerk of
Caroline county court, that certain original papers rela-
ting to the proceedings in said court have been lost or
stolen from the office of the said clerk; and from the loss
of said papers great evil may ensue unless prevented by
legislation—Therefore,

Preamble

Section 1. Be it enacted by the General Assembly of
Maryland, That in all cases pending in Caroline county
court, and now marked upon the trial docket thereof of
March term eighteen hundred and forty-four, and marked
on said trial docket with the numbers fifty-four, fifty-five,
fifty-six and fifty-seven, and so on continuously up to num-
ber one hundred eighty-five inclusive, the clerk of said
court be, and he is hereby authorized and directed to
prepare from the titlings and other memoranda in his pos-
session accurate copies of the original writs which had
been filed in said causes and which have been lost or
stolen, which said copies he shall file among the papers
in his office appertaining to the said several cases respec-
tively, and the said copies when they shall be so filed as
aforesaid with the certificate of the said clerk endorsed
on each writ respectively, certifying that the same is a
