CHAP. 110.

An act relating to Surveys.

17, 1842.

Be it enacted by the General Assembly of Maryland,
That from and after the passage of this act, any warrant of
resurvey issued from any of the courts of this State, may
be executed after ten days notice to the parties in the cause
or their counsel of record, unless such notice be waived by
consent, any law to the contrary notwithstanding.

CHAPTER 109.

 

An act relating to Sheriffs.

17, 1842.

Whereas, it often happens that in many of the counties
there is no coroner, by reason whereof the sheriff cannot
be sued during his term—therefore,

Preamble.

Be it enacted by the General Assembly of Maryland,
That in all cases where there is no coroner in a county it
may be lawful for the plaintiff to file his declaration against
the sheriff, and his securities, or against the person who is
for the time the sheriff when the suit is against him on his
individual account, and having a copy thereof set up at the
court house door, at least ten days before the sitting of the
county court, and if no appearance by the defendants before
the first three days of the term, then judgment shall be en-

tered up against them; provided, that the plaintiff shall make
affidavit of the truth of the demand; and if the State shall
be the plaintiff in its own right, then that a statement of the
treasurer, in his own hand writing shall be evidence of the
amount due t!ie State, but that no execution shall issue on
such judgment, until twelve months after said third day of
the term.

An act to divorce Jane Abell, of the City of Baltimore,

from her husband Benjamin H. Abell.

Be it enacted by the General Assembly of Maryland,
That Jane Abell, be and she is hereby divorced from her
husband Benjamin H. Abell, a vinculo matrimonii.
