CHAP. 261

Persons of-
fending sub-
ject to indict-
ment.

Sec. 2. And be it enacted, That all persons offending
against the provisions of this act, shall be proceeded against
by indictment in Harford county court, and Baltimore coun-
ty court, as for other misdemeanors, and if any person is
seen in any of the waters aforesaid, in any boat, craft or
vessel of less than thirty tons burthen, with a gun, during
the season for shooting ducks, the evidence of such fact
shall he prima facie evidence that such person is guilty of
offending against the first section of this act.

Fine and im-
prisonment.

Sec. 3. And be it enacted, That any person who shall
aid or abet in any manner, by furnishing a boat, vessel or
craft, or gun or ammunition to any one lor the purpose of
shooting ducks against the provisions of this act; or who
shall purchase ducks from any one who has shot them con-
trary to the provisions of this act, knowing that they were
so unlawfully shot, shall be deemed guilty of a misdemean-
or, and upon conviction, on indictment in any county court,
shall be fined and imprisoned, or either, at the discretion of
the court.

Sec. 4. And be it enacted, That any person offending
against this act, may be prosecuted For the same at any
time before the sitting of the county courts; provided, that

the provisions and penalties of this act shall not apply to
persons gunning in the day time with small fire-arms, ex-
cept where an individual guns in said boats immediately a-
long the ducking shores of any person or persons living or
owning lands on said waters.

Sec. 5. And be it enacted, That the penalties and provi-
sions of this act shall be confined exclusively to those per-
sons paddling or gunning with either large or small fire-
arms after night, except as is provided for in the fourth sec-
tion aforesaid.

An act to incorporate the Chesapeake Steam Saw Milt
Company.

Incorporated.

Section 1. Be it. enacted by the General Assembly of
Maryland, That John C. Ely, William Harrison, Samuel
E. Rice, John A. Robb, John Watchman and their asso-
ciates, and all such other persons or bodies corporate as
may hereafter become stockholders in the corporation here-
by created, shall be and are hereby created and declared a
body corporate by the name of the Chesapeake Steam Saw
