CHAPTER 46.

An act to authorise Thomas Sater, late Collector of Balti-

more County, to close his Collections.

Time extended
to make col-
lections.

Make affidavit.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Thomas Sater, late collector for Balti-
more county, be, and he is hereby authorised to collect all
arrearages of tax due to said Sater, in the same manner,
and with as full power, as he could have done at any time,
to enable him to complete his collections; provided never-
theless, before he shall coerce, by any legal process, he
shall make oath, before some justice of the peace for said
county, that such tax or arrears thereof remain due, and
he bath not received any part, parcel or security, or any
person for him, for any part of such claim as may appear
to be due.

In force.

SEC. 2. And be it enacted, That this act shall remain in
full force until the end of the year eighteen hundred and
forty-two, and no longer.

CHAPTER 47.

Passed April 1,
1841.

An act to authorise the Tide Water Canal Company, to is-
sue Toll Notes, to a limited amount, on the pledge, by
mortgage, of its Works and Property.

May issue toll
notes to amount
of $500, 000.

Be it enacted by the General Assembly of Maryland,
That the Tide Water Canal Company, be and it is hereby
authorised to issue, from time to time, toll notes to an
amount, not exceeding at any time in actual issues, the sum of
five hundred thousand dollars, and which shall purport on then
face to be receivable in payment of tolls on said canal, and
to be convertible, at the pleasure of the holder, into the

Works, &c. to
be a mortgage

for redemption.

stock of said company; provided nevertheless, that the said
company shall, on or before the fifteenth day of June next,
execute a mortgage upon all its works and property, to, se-
cure the payment, in money, of all such toll notes as may
be issued in virtue of this act, which shall not be absorbed
in the collection of tolls, or be funded in the stock of said
company, within the period of five years from the date of
said mortgage; which said mortgage shall be made for the
benefit of the holders of such toll notes, to the Treasurer
of the Western Shore of this State, in his official capacity,
