CHAP. 233.

of all the costs and expenses shall be rendered to the coun-
ty commissioners by the aforesaid bridge commissioners,
or a majority of them, and then the county commissioners
are hereby authorised to pay over to the said bridge com-
sioners, or their order, such sum or sums of money as may
have been levied for that purpose, to the amount of said
cost and expenses, if such cost does not exceed the sum or
sums so levied.

An act relating to the Administration of Justice.

Filing appeal
bond to stay ex-
ecution.

Be it enacted by the General Assembly of Maryland,
That in all cases of appeal from the judgment or decree of
any court of this State, wherein an appeal is by law allow-
ed, the filing of an appeal bond, approved as the law pre-
scribes, shall stay any execution which may, or has been,
or shall be issued cm any such judgment or decree,
whether such such execution may have been in part exe-

cuted or not; provided, that the party requiring the execu-
tion to be stayed, shall pay all the costs of the execution;
and it shall be the duty of the sheriff or other officer, in
whose hands such execution may be, upon the exhibition
to him of satisfactory evidence that an appeal bond has
been filed and approved, and upon the receipt of the costs
which have accrued on the said executions, to stay all fur-
ther proceedings, and discharge the party from custody, or
deliver up the property, as the case may be; provided, that
this act shall not extend to appeals from the judgments of
courts of common law; rendered by confession, or to any
judgment rendered on verdict, unless a bill of exceptions
has been taken, or a motion in arrest of judgment has been
over-ruled.
