CHAP. 230.

of said Potomac Coal and Iron Company, so as connect
any lateral rail road with the rail road or roads of said
company, by paying said company such sum or sums as
may be agreed upon by three disinterested persons, ap-
pointed by the commissioners of the tax of Allegany coun-
ty, to value, said damage or damages.

Not exempted
from taxation.

SEC. 11. And be it enacted, That nothing in this act con-
tained, shall be construed to exempt the lands and other
property of said company from taxation.

An act to amend the Constitution and Form of Govern-
ment of the State of Maryland.

nate during re-
cess, Governor
to order election.
|
SECTION 1. Be it enacted by the General Assembly of Ma-
ryland, That, upon the resignation of a Senator during the
recess of the Senate, communicated, in writing, to the Go-
vernor, or upon the death of any Senator during the re-
cess, it shall be the duty of the Governor to issue a war-
rant of election, to supply vacancies thus created, in the
same manner as the President of the Senate for the time
being is authorised to do in virtue of an act to amend the
constitution and form of government of the State of Mary-
land, chapter one hundred and ninety-seven, passed at De-
cember session, eighteen hundred and thirty-six, and con-
firmed December session, eighteen hundred and thirty-seven.

SEC. 2. And be it enacted, That, in all cases of resigna-
tion or death, as aforesaid, the elections to supply the va-
cancies shall take place at the time and places of the an-
nual election of delegates, unless such resignation or death
shall occur between the first day of September and the
meeting of the General Assembly in any year, in which
event elections shall he held at such time as shall be direct-
ed by the Governor, with such notice as is provided by the
act of Assembly for the amendments of the constitution
and form of government, as aforesaid.

SEC. 3. And be it enacted, That the provisions of the
fourteenth and fifteenth sections of the act of December
session of the year eighteen hundred and thirty-six, chap-
for one hundred and ninety-seven, be, and the same are
hereby declared to extend to the offices of the Judges of
the several Judicial Districts of this State, and to all other
offices of this State known to the constitution, concerning
