as it may deem equitable towards the said company, and
necessary to the accommodation of the public travel, or use
of said rail road.

CHAP. 215.

SEC. 7. And be it enacted, That this act, and no par
thereof, shall be so construed as to give to said company
any banking privilege, or any right to issue any bank
note or notes, or certificates of deposite payable to bearer,
or small notes for circulation of any kind whatever.

Banking forbid.

SEC. 8. And be it enacted, That all such parts of this act
as relate to the establishment, working or carrying on of
mines or manufactories, may be modified or repealed by the
Legislature of this State, at any time after thirty years from
the passage of this act; provided, that the Legislature may
at any time order proceedings to vacate this charter, if the
same shall be violated.

Right to repeal.

SEC. 9. And be it enacted, That this act shall commence
and be in force from and after the passage thereof, and shall
not be affected or restrained by the act of December ses-
sion, eighteen hundred and thirty-eight, chapter two hun-
fired and sixty-seven, entitled an act prescribing general
regulations for the incorporation of manufacturing and mi-
ning companies.

In force.

SEC. 10. And be it enacted, That any company hereafter
formed, shall have the privilege of passing over the lands
of said Cumberland Coal and Iron Company, so as to con-
nect any lateral rail road with the rail road or roads of said
company, by paying said company such sum or sums, as
may be agreed upon by three disinterested persons, appoin-
ted by the commissioners of the tax of Allegany county to
value said damage or damages.

SEC. 11. And be it enacted, That nothing in this act con-
tained, shall be construed to exempt the lands and other
property of said company from taxation.

CHAPTER 215.

How construed.

An act for clearing out of Pocomoke River, in Worcester

County, by means of a Lottery.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Henry Franklin, Peter Whaley, Za-
dock P. Henry, Levi Cathell and Thomas A. Spence, of
Worcester county, be and they are hereby appointed
