of, upon a statement on the oath of the said commissioners
of the amount thereof; provided, the expenses shall not ex-
ceed in Frederick county, the sum of one hundred and fifty
dollars, nor in Carroll county the sum of five hundred dol-
lars.

CHAP. 166.

Cost limited.

SEC. 3. And be it enacted, That the commissioners, or a
majority of them, shall ascertain the damage that may be
sustained by any person or persons through whose lands
the said road may pass, taking into consideration the ad-
vantages and disadvantages to them; and the damages so
ascertained shall be levied and assessed in the same manner
as directed in the second section of this bill.

How paid.

SEC. 4. And be it enacted, That the commissioners, be-
fore they shall proceed to act, shall take an oath or affir-
mation, as the case may be, before some justice of the
peace, that they will without favor, partiality or prejudice,
assess the damages sustained by the persons through whose
lands the said road shall pass.

Oath of office.

SEC. 5. And be it enacted, That nothing contained in this
act shall be so construed as to prevent the right of appeal,
in like manner as though the commissioners had been ap-
pointed in the usual way.

Right of appeal.

SEC. 6. And be it enacted, That this act shall be entirely
void unless it shall be approved by the commissioners of
tax of Carroll county, and the levy court of Frederick
county; and the commissioners therein named shall not pro-
ceed to lay out or open the said road, or do any thing
whatever in execution of this act, unless both the levy court
of Frederick county and the commissioners of tax of Car-
roll county shall assent thereto, by orders in writing, to be
passed by the said respective boards.

CHAPTER 166.

Acceptance re-
quired.

An act to authorise Richard R. Waters, late Sheriff and
Collector of Montgomery County, to complete his Col-
lections.

Passed Feb. 27,
1841.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Richard R. Waters, late sheriff and col-
lector of Montgomery county, he and he is hereby autho-
rised to collect until the first day of March, eighteen hun-
dred and forty-three, all firms, forfeitures, amercements, of-
ficers fees, public dues and county taxes, which were placed
