Mayor and City Council, and if said bids be satisfactory to
the said Mayor and City Council, it shall sell said bonds or
any part thereof to the highest bidder or bidders therefor, of
whose ability to comply with the terms of sale the said
Mayor and City Council, in its discretion, is satisfied. In
the event that the bonds be sold, the proceeds thereof shall
be placed in a separate fund and shall be used for the pur-
pose of acquiring land and constructing such works of any
kind or character within or without the City Limits or within
or without the State of Maryland as may be necessary to
protect the City of Cumberland and the inhabitants thereof
from floods occurring in either Wills Creek or the Potomac
River or both, and for the payment of all expenses incident to
carrying out said work.

SEC. 5. And be it further enacted, That the Mayor and
City Council of Cumberland be and it is hereby authorized
and empowered to accept from any Federal or State agency
grants for or in aid of flood protection for said City, and to
make such contracts containing such terms, provisions and
conditions as in the discretion of the Mayor and City Council
may seem necessary, proper or advisable for the purpose of
obtaining or securing grants, engineering or financial assist-
ance from any Federal or State agency willing to extend the
same in furtherance of the purposes of this Act.

SEC. 5. (a) And be it further enacted, That no additional
or further bonds shall be issued under the authority granted
by Chapter 131 of the Acts of the Extraordinary Session of
1936.

SEC. 6. And be it further enacted, That any and all Acts
or parts of Acts or any part or parts of the Charter of the
City of Cumberland, Maryland, conflicting in any way here-
with, is or are repealed insofar as, and to the extent that, the
same shall so conflict, and none of the limitations or restric-
tions on the power of the said Mayor and City Council to
borrow money or issue and sell bonds contained in the
Charter of said municipality or in any other law which limits,
restricts or in any other way affects the powers herein granted,
nor any of the provisions of Sections 34-36 of Article 31 of
the Annotated Code of Maryland (1939 Edition), as amended
by the 1947 Supplement, shall be applicable hereto.

SEC. 7. And be it further enacted, That this Act is hereby
declared to be an emergency measure and necessary for the
immediate preservation of the public health and safety, and
having been passed by a yea and nay vote, supported by three-
fifths of all of the members elected to each of the two Houses
