having been passed by a yea and nay vote, supported by three-
fifths of all of the members elected to each of the two Houses
of the General Assembly of Maryland, the same shall take
effect from the date of its passage.

CHAPTER 368
(House Bill 445)

AN ACT to repeal Chapters 456 and 457 of the Acts of 1937,
and Chapter 743 of the Acts of 1939, pertaining to Bond
Issues for Flood Control Work in and about the City of
Cumberland, and to authorize the Mayor and City Council
of Cumberland, Maryland, to issue coupon bonds in the
amount of Eight Hundred Thousand Dollars ($800, 000. 00),
and to provide for payment of the interest thereon and the
principal thereof at maturity, to be known as "Cumberland
Flood Protection Bonds of 1949", and to provide that the
sale of said bonds be used for the acquisition of land and
the construction of any and all works needed or necessary
for flood protection in and around the City of Cumberland
and the payment for any proper expense incident thereto;
to repeal all Acts or parts of Acts inconsistent with the
provisions hereof; and to provide that no further bonds
shall be issued under the authority of Chapter 131 of the
Acts of the Extraordinary Session of 1936.

WHEREAS, Chapter 131 of the Acts of 1936 (Extraordinary
Session) of the General Assembly of Maryland, authorized a
Bond issue of f500, 0000. 00 for replacement or improvement
of public property destroyed by the 1936 Flood of which
$300, 000. 00 has been issued, leaving a balance of $200, 000. 00
unissued; and

WHEREAS, Chapter 457 of the Acts of 1937 of the General
Assembly of Maryland as amended by Chapter 743 of the
Acts of 1939 of the General Assembly of Maryland provided
for a Bond issue of $500, 000. 00 to be used for a Cross-town
Highway or Flood Control purposes, the entire sum of which
is unissued; and

WHEREAS, Chapter 456 of Acts of 1937 provided for a
$100, 000. 00 Bond issue for purpose of acquiring land and
rights of way for Flood Control, the entire sum of which is
unissued; and
