diction to be unconstitutional or invalid, in any particular
application, and the said clause, sentence, paragraph or sec-
tion of this Act. shall be constitutional and valid when
otherwise applied, such adjudication shall not affect, impair
or invalidate said clause, sentence, paragraph or section, but
shall be confined to the particular application so found un-
constitutional or invalid.
SEC. 3. Be it -further enacted, That all laws or parts of
laws, whether public local or public general, inconsistent
with any of the provisions of this Act be and they are hereby
repealed to the extent of such inconsistency.
SEC. 4. Be it further enacted, That this Act shall take
effect on July 1, 1949.

AN ACT to repeal and re-enact Sections 31 and 33 of Article
88B of the Annotated Code of Maryland (1939 Edition and
1947 Supplement), title "State Police", sub-title "Pen-
sions", relating to pensions for members of the Depart-
ment of State Police.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 31 and 33 of Article 88B of the Annotated
Code of Maryland (1939 Edition and 1947 Supplement) be
and they are hereby repealed and re-enacted, with amend-
ments, to read as follows:
31. Whenever any of the employees of the Department of
Maryland State Police, who have elected not to become mem-
bers of the State Police Retirement System of the State of
Maryland, and any of the License Examiners of the Com-
missioner of Motor Vehicles shall have given meritorious
service as such employee for a period of ten continuous years,
and shall have reached the age of 55 years, such employee
shall be eligible for retirement upon his voluntary application
or may be retired by the Superintendent of the Department
of Maryland State Police, provided such employee be found,
after medical examination given by a Medical Board of three
physicians, consisting of the Medical Examiner of the De-
