conduct an examination for the applicant based upon the
provisions of this sub-title as soon after the request is
received as is practicable and if the applicant is found
qualified in the discretion of the Board, the Board shall
then issue a "permit of competency, " It is hereby declared
to be the legislative intent that the applicant for a "per-
mit of competency" shall not be required to display the
theoretical knowledge required for the holder of a first-
class certificate but rather that he be qualified in the prac-
tical aspects of conditions relating to a small mine with
particular emphasis on the conditions relating to the safety
of the employees of such mine. The applicant shall pay an
examination fee of one dollar to the Bureau of Mines for
each examination taken.

(c) Applicants for fire-boss certificates of competency
shall produce evidence satisfactory to the Examining
Board that they are residents of Maryland, at least twenty-
one years of age, and shall furnish a verified history of
their experience in mining employments, showing in detail
the several mines in which they have worked, their loca-
tion, the particular employments followed therein during
a period of at least one year, and particularly their knowl-
edge of gaseous mines and the extent of experience therein;
and shall pay an examination fee of three dollars to the
State.

41. Each successful applicant shall upon paying a cer-
tificate fee of one dollar to the state be entitled to a certifi-
cate setting forth the type of certificate held, to be signed
by the Examining Board or by the Director if the permit
of competency is issued by him. Such certificate shall state
the name, age and residence of the person certified, the
position for which qualified and his experience; and upon
such certificate shall be mounted a photograph of the
holder to be furnished by himself across which shall be
impressed the seal of the Examining Board or in the case
of a permit of competency the certificate shall be signed
by the; Director. No certificate shall be transferable. In
case of loss or destruction of a certificate the Examining
Board or the Director as the case may be upon being satis-
fied thereof shall supply a copy of such certificate to the
person losing the same, upon payment to the State of a
fee of fifty cents.

43. The Examining Board or the Director as the case
may be shall provide for the keeping of the applications
for such certificates, the supporting evidences, and the rec-
ords of the examinations as a permanent record; and shall
endorse upon each such application their action thereon.
