CHAPTER 29
(House Bill 163)

AN ACT to add a new section to Article 16 of the Annotated
Code of Maryland (1939 Edition and 1947 Supplement),
title 'Chancery", sub-title "Divorce", said new section to be
known as Section 41B, and to follow immediately after
Section 41A of said Article, legitimating the issue of any
marriage annulled in this State and also those of certain
marriages for which a decree of divorce is entered, and
relating to the innocent parties thereto.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and it is hereby added to Article
16 of the Annotated Code of Maryland (1939 Edition and
1947 Supplement), title 'Chancery", sub-title "Divorce", said
new section to be known as Section 41B, to follow immediately
after Section 41A of said Article, and to read as follows:

41B. This section shall apply whenever any criminal or
equity Court of this State has for any reason annulled a mar-
riage, and declared it to be null and void, or whenever any
equity Court of this State has decreed a divorce a vinculo
matrimonii for any cause which by the laws of this State
render a marriage null and void ab initio. In such event,
if it shall appear that such marriage was. contracted in good
faith by one of the parties thereto, and in ignorance of any
obstacle to its validity, that fact shall be found and declared
in the decree. In such case the issue of such a marriage shall
be deemed and declared to be the legitimate issue of the parents
thereof.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1949.
