CHAPTER 22
(House Bill 88)

AN ACT to add a new section to Article 27 of the Annotated
Code of Maryland (1939 Edition), title "Crimes and
Punishments'", said new section to be known as Section
545A, to follow immediately after Section 545 of said
Article, and to be under the sub-title "Rape", relating to
verdicts "without capital punishment" for the crimes of
rape and carnal knowledge.

SECTION 1. Be it enacted Toy the General Assembly of Mary-
land, That a new section be and the same is hereby added to
Article 27 of the Annotated Code of Maryland (1939 Edition),
said new section to be known as Section 545A, to follow imme-
diately after Section 545 of said Article, to be under the
sub-title "Rape", and to read as follows:

545A. The jury which finds any person guilty of rape
under Section 544 of this sub-title, or guilty of carnal knowl-
edge under Section 545 of this sub-title, may add to their
verdict the words "without capital punishment", in which
event the sentence of the Court shall not exceed twenty years
in the Penitentiary; and in no such case in which the jury
has returned a verdict including the words "without capital
punishment" shall the court in imposing sentence, sentence
the convicted person to pay the death penalty or to be con-
fined in the Penitentiary for more than twenty years.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1949.

CHAPTER 23

(House Bill 101 >

AN ACT to add a new section to Article 63 of the Annotated
Code of Maryland (1939 Edition), title "Mechanics' Lien",
to be under sub-title "Livestock", said new section to be
known as Section 51, and to follow immediately after
Section 50 of said Article, relating to lien for board and
other expenses for giving care and custody to horses or
other livestock.
