AN ACT to repeal and re-enact, with amendments, Sub-sec-
tion (9) of Section 291 of the Code of Public Local Laws
of Baltimore County (Smith's 1948 Edition), title "Public
Works", sub-title "Roads, Bridges, Sidewalks and Storm
Water Drainage", to authorize the Roads Engineer of
Baltimore County to perform work involving more than
$5, 000. 00 when prior to the commencement of said
work bids have been accepted for the materials to be used
therein and the estimated outlay for labor will not exceed
the sum of f 5, 000. 00.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sub-section (9) of Section 291 of the Code of Pub-
lic Local Laws of Baltimore County (Smith's 1948 Edition),
title "Public Works", sub-title "Roads, Bridges, Sidewalks
and Storm Water Drainage", be and the same is hereb3T re-
pealed and re-enacted, with amendments, to read as follows:
291. (9) Whenever work on any road, bridge or drain in-
volves an estimated outlay of $5, 000. 00 or more, plans and
specifications therefor shall be prepared by the Roads En-
gineer and bids for work invited by reasonable publication
in such papers as the Commissioners may designate; but
said Commissioners shall not be bound to have such work
done by contract if it is found after receiving bids therefor
that the same can be done at a lower cost by direct employ-
ment of required labor. Provided, however, that if the Pur-
chasing Department of Baltimore County, shall prior to the
commencement of said work, pursuant to the regulations of
the County Commissioners, have advertised and accepted
bids for all or substantially all of the materials and supplies
to be used in said work, and said materials and supplies
are under contract, and the estimated outlay for labor does
not exceed the sum of $5, 000. 00, the Roads Engineer may
proceed to perform work by the direct employment of the
required labor.
