erages at retail shall sell any alcoholic beverages except for
cash and no manufacturer or wholesaler shall sell any beer
to any retail dealer except for cash on delivery. Cash ol^
posits for returnable containers shall be required at the time
of delivery or sale. For the purposes of this Section, in addi-
tion to currency, checks accepted for payment which are not
postdated and are promptly deposited for collection by the
licensee shall also be deemed to be cash. No suit or action
ex contractu to enforce or collect any claim for credit ex-
tended, or to enforce payment of any check given for payment
for alcoholic beverages in violation of this section, shall be
maintained in this state. Any check given in payment for
alcoholic beverages to any licensee coming under the terms
of this section, which shall be returned uncollected, shall be
deemed prima facie evidence in any civil case of a violation
of this section.

Any person violating the provisions of this section shall
be deemed guilty of a misdemeanor and upon conviction
thereof shall be subject to a fine of not more than Five Hun-
dred Dollars ($500. 00) or to imprisonment for not more than
six months in the House of Correction or Jail, or both fined
and imprisoned.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1949.

(House Bill 629)

AN ACT to repeal and re-enact, with amendments, Section
249 (a) of Article 66 1/2 of the Annotated Code of Maryland
(1947 Supplement), title "Motor Vehicles", sub-title "Oper-
ation of Vehicles Upon Highways", relating to the width
of farm equipment and implements of husbandry.

SECTION 1. Be- it enacted by the General Assembly of Mary-
land, That Section 249 (a) of Article 66 1/2 of the Annotated
Code of Maryland (1947 Supplement), title "Motor Vehicles",
sub-title "Operation of Vehicles Upon Highways", be and it is
hereby repealed and re-enacted, with amendments, to read
as follows:

249. (Width of Motor Vehicles; Gross Weight Per Inch
Width of Solid Tire; Permit Required for Excess Width or
