section thereof that is to be assessed, by mail and by adver-
tising in one or more newspapers that have general circula-
tion in the town of Berwyn Heights, which advertising shall
state the date on which such assessment shall be made and
warning all abutting owners to appear at the time and place
stated in said advertisement or notices, to show cause, if any
there be, why said assessment should not be made as pro-
posed. Any person aggrieved by the action of the Commis-
sioners of Berwyn Heights, shall have the right to appeal to
the Circuit Court for Prince George's County, Maryland, pro-
vided such appeal is taken within thirty days next 'Succeeding
the day on which said assessment is made.

33F. When construction of streets, alleys, curbs, sidewalks
and gutters is authorized, the Commissioners of Berwyn
Heights shall invite proposals for said construction by ad-
vertisement for two weeks in some newspaper having general
circulation in the town of Berywn Heights, and the Commis-
sioners shall, in all cases, award the contract for such con-
struction to the lowest responsible bidder therefor, reserving
at all times the right to reject any and all bids received. All
contractors for such construction shall give bond in such
sums as the Commissioners shall require with sufficient surety
or sureties, to be approved by the Commissioners, for the
faithful performance of their contract.

SEC. 2. And be it further enacted, That the provisions of
this Act shall not become effective until it shall have been
submitted to the qualified voters of the Town of Berwyn
Heights at a special election to be held on Tuesday, May 10th,
1949. There shall be printed on the ballots to be used at said
election, the title of this Act and underneath said title, on
separate lines, a box or square to the right of and opposite
the words "For Special Assessments for Street Improvements'7
and a corresponding box or square to the right of and opposite
the words "Against Special Assessments for Street Improve-
ments", so that the voters shall be able to designate by a
cross mark, in the proper box or square, his or her decision
for or against said special assessments. If a majority of the
votes cast on said question shall be "For* Special Assessments
for Street Improvements", then this Act shall become immedi-
ately effective. If a majority of the votes cast shall be
"Against Special Assessments for Street Improvements", then
this Act shall be null and void and of no effect whatsoever.

SEC. 3. And be it further enacted, That this Act is hereby
declared to be an emergency law and, necessary for the imme-
diate preservation of the public health and safety, and having
