CHAPTER 712

(House Bill 280)

AN ACT to add six new sections to the Prince George's County
Code (1943 Edition), being additions to Article 17 of the
Code of Public Local Laws of Maryland, title "Prince
George's County", sub-title "Berwyn Heights", said new
sections to be known as Sections 33A to 33F, inclusive, and
to follow immediately after Section 33 thereof, granting
said town the power to construct and maintain streets,
alleys, curbs, sidewalks and gutters, to borrow money and
to levy a special assessment upon the property owners of
said town for street improvements and providing for a
referendum thereon.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That six new sections be and they are hereby added to
Article 17 of the Code of Public Local Laws of Maryland
(1943 Edition), title "Prince George's County", sub-title
"Berwyn Heights", said new sections to be known as Sections
33A to 33F, inclusive, to follow immediately after Section 33
thereof, and to read as follows:

33A. The Commissioners of Berwyn Heights, Maryland, a
municipal corporation, are hereby authorized to construct,
maintain and repair streets, alleys, curbs, sidewalks and gut-
ters in said town of Berwyn Heights, when, where, and in
the manner to be determined by the Commissioners, provided
that when such construction is to be paid for by special
assessment then such construction shall not be authorized
without the signature consent or request of fifty-one per cent
(51%) of the front foot abutting property owners, repre-
senting at least fifty-one per cent,. (51%) of the front footage,
affected on the street or section thereof on which construction
is proposed.

33B. To effectuate the construction of streets, alleys,
curbs, sidewalks and gutters, the Commissioners of Berwyn
Heights, Maryland, are hereby authorized and empowered to
borrow from time to time on the credit of the town, a sum or
sums of money which shall not, however, exceed in amount
the total sum of eight, per cent of the assessed valuation of
all real property in the town appearing on the assessment
books of Prince George's County, State of Maryland, and to
issue bonds or certificates of indebtedness therefor; which
shall be payable on or before twenty years from the date of
issuance, with interest not to exceed the rate of six per cent,
payable semi-annually? unless of shorter duration than at
