after this Article becomes effective shall thereafter be serv-
iced and redeemed by payments from the general funds of
the City, including the water revenues. It is the intent and
purpose of this sub-section to require that water revenues
shall become part of the general funds of the City when the
bonded indebtedness to which they are pledged at the time
this Article becomes v effective has been fully retired and
liquidated.
155. EXCESS WATER, (a) The Mayor and City Council
also may sell excess water, at such price as it shall deem
proper, without regard to its capital and interest require-
ments or to its maintenance costs, to the end that excess
water shall not be wasted, and that the City shall derive
some compensation therefor. No water shall be sold as ex-
cess water for less than the actual cost of filtration and other
treatment.
(b) Excess water shall be that amount of water which is
in storage in the impounding dams above the pumping level
as shall be in excess of an amount equal to two hundred
times the average amount of water then being delivered to
the regular water takers for their daily consumption. When
the water so held in the impounding dams shall not be in
excess of this amount, no water shall be sold as excess water.
(c) No excess water shall be sold to any person, firm or
corporation for other than manufacturing or industrial pur-
poses, or when the use of such excess water would diminish
the amount of water then being furnished to such person,
firm or corporation under the regular established rates of
the City. In case of a sale of excess water to a non-user of
water under said regular established rates, such excess water
shall not be sold in an amount less than four hundred
thousand gallons per twenty-four hour period, and all of it
must be used for manufacturing and industrial purposes,
except in case of shut down, strike, act of God, or other
emergency; and in like manner the City may discontinue the
sale of excess water so long as any such emergency may
exist. In the sale of excess water the Mayor and City Coun-
cil shall reserve the right to apportion the supply of such
excess water among the eligible applicants who may apply
for the same; and the Mayor and City Council may stipulate
such other conditions to the sale as may seem reasonable and
proper for the protection of the interests of the City.
156. OUTSIDE SALES. The City may sell water outside
the limits of the City, to ordinary domestic and commercial
consumers, subject to whatever rates and conditions may be
set by the Mayor and City Council, except that no such water
