City Engineer, who without unnecessary delay shall then
transmit to the Circuit Court a record of the proceedings of
the Mayor and City Council and of the commissioners ap-
pointed to assess damages and benefits, for the work on the
street or alley as to which the appeal is made.
(f) Said appeal shall be heard at the next succeeding term
of the Circuit Court, with the party taking the appeal to be
docketed as the plaintiff and the Mayor and City Council to
be docketed as defendant. The plaintiff shall be entitled to
a jury trial, and the amount assessed by the jury as damages
or benefits shall stand in the place and stead of the assess-
ment made by the commissioners. The Court may quash the
proceedings upon a motion of the plaintiff, for errors or
omissions rendering them fatally defective. Either party may
take exception to any ruling of the Court upon matters of
law arising during the progress of the trial, and either party
may appeal to the Court of Appeals from any such ruling,
or from the action of the Court in quashing or refusing to
quash such proceedings.
DEPARTMENT OF FINANCE
106. ESTABLISHED. There shall be a Department of
Finance, under the supervision of the City Manager as
Director of Finance. If the Mayor and City Council shall by
ordinance create the separate position of Director of Finance,
said official shall be a member of the Classified Service under
the general supervision of the City Manager. Said Depart-
ment shall consist of the Director of Finance and of the
several divisions provided herein, with the duties specified.
107. DUTIES OF DIRECTOR. (a) The Director of
Finance shall have general charge of the financial affairs of
the City.
(b) He shall prepare an annual budget to be submitted to
the Mayor and City Council, including therein estimates for
current expenses, capital expenditures, and expenditures
required by law or contract.
(c) He shall supervise and be responsible for the disburse-
ment of all monies and have control over all expenditures, to
assure that budget appropriations are not exceeded.
(d) He shall maintain a general accounting system for the
City arid keep separate accounts for each department and
agency, in such form as the Mayor and City Council may
require.
